DESCRIPTION<\/h3>\n\n\n\n<p>1.1 These Terms and Conditions set out the rights and obligations of the parties in relation to the provision of services (hereinafter referred to as the \u2018services\u2019) via the website dryad-miniworlds.be (hereinafter referred to as the \u2018website\u2019). These Terms and Conditions govern all sales of services made via the website.<\/p>\n\n\n\n<p>1.2. These Terms and Conditions are agreed between, on the one hand,<\/p>\n\n\n\n<p><strong>Thomas Gimzer<\/strong><br>Rue Jacques Bassem 68<br>1160 Auderghem<br>Belgium<br><a href=\"mailto:hello@dryad-miniworlds.be\">hello@dryad-miniworlds.be<\/a><br>+32 485 57 22 21<\/p>\n\n\n\n<p>affiliated with PRODUCTIONS ASSOCI\u00c9ES ASBL, registered with the Belgian Crossroads Bank for Enterprises under number 0896.755.397 (VAT BE 0896.755.397) whose registered office is situated at 72 Rue Coenraets, 1060 Brussels, Belgium, hereinafter referred to as the \u201cService Provider\u201d<\/p>\n\n\n\n<p>-and, on the other hand, the person placing an order, hereinafter referred to as the \u2018Customer\u2019.<\/p>\n\n\n\n<p>The Client and the Service Provider are hereinafter jointly referred to as the \u2018Parties\u2019.<\/p>\n\n\n\n<p>1.3 Any order for a service offered on the website (hereinafter \u201cthe Order\u201d) implies that the Customer has first read and expressly accepted the T&amp;Cs, without such acceptance being conditional upon a handwritten signature from the Customer. In accordance with the provisions of the Act of 9 July 2001 establishing certain rules relating to the legal framework for electronic signatures, the validation of the order form constitutes an electronic signature which, between the parties, has the same legal effect as a handwritten signature and serves as proof of the completeness of the order and of the payability of the sums due in performance of the order.<\/p>\n\n\n\n<p>1.4 The Customer declares that they have full legal capacity.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">PRODUCTS\/SERVICES FOR SALE<\/h3>\n\n\n\n<p>The services offered are those listed on the website, together with a description of their key features, as at the date and time the Customer views the website. The Service Provider shall use all reasonable means to display the availability of services in real time on the website, but shall not be held liable if a service is no longer available to fulfil the order. In the event that any of the services ordered are unavailable, the Customer will be informed and will have the option either to amend their order or to cancel it, in which case they will be refunded the amount of their order if payment has already been made.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">PRICES OF THE SERVICES LISTED<\/h3>\n\n\n\n<p>3.1 The price of each service (hereinafter \u201cthe purchase price\u201d) is displayed on the website in euros and includes VAT. This price applies to countries where delivery is available and does not include any discounts or vouchers granted to the Customer on a personal basis. The Service Provider reserves the right to change its prices at any time, but services will be invoiced on the basis of the purchase price in force at the time of the order.<\/p>\n\n\n\n<p>3.2 Services are delivered exclusively within Europe, including non-EU countries.<\/p>\n\n\n\n<p>The delivery times stated are not binding but are provided for information purposes only. No delay shall give rise to the payment of damages to the Client. The Service Provider is entitled to make partial deliveries. In the event of failure to provide the services, any sums paid by the Client shall be refunded without interest or compensation.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">ORDERING PROCEDURES<\/h3>\n\n\n\n<p>4.1 To place an order, the Customer must complete the order form provided on the website, providing the information required for identification, including their surname, first name and delivery address. By doing so, the Customer declares that they fully and unreservedly accept these Terms and Conditions in their entirety and undertakes to pay the full amount due. The Service Provider cannot be held liable for the consequences of the provision of incorrect information.<\/p>\n\n\n\n<p>4.2 The Service Provider shall confirm each order by sending an email stating, in particular:<\/p>\n\n\n\n<ol class=\"wp-block-list\">\n<li>the main features of the service ordered;<\/li>\n\n\n\n<li>the Service Provider\u2019s identity, including its company registration number and trading name;<\/li>\n\n\n\n<li>the Service Provider\u2019s address, telephone number and email address;<\/li>\n\n\n\n<li>the total price of the services, including all taxes;<\/li>\n\n\n\n<li>the terms of payment, delivery and performance, and the date by which the company undertakes to provide the services;<\/li>\n\n\n\n<li>the company&#8217;s procedures for handling complaints;<\/li>\n\n\n\n<li>the conditions, time limit and procedures for exercising the right of withdrawal;<\/li>\n\n\n\n<li>the circumstances in which the consumer will not be entitled to the right of withdrawal, as set out in Article 7 of the Terms and Conditions;<\/li>\n\n\n\n<li>the option of contacting the European Online Dispute Resolution platform to initiate an amicable settlement procedure.<\/li>\n<\/ol>\n\n\n\n<p>The data recorded by the Service Provider, together with the order confirmation, shall constitute proof of the contractual relationship between the parties.<\/p>\n\n\n\n<p>4.3 The Service Provider reserves the right to refuse or cancel any order or delivery in the event of an existing dispute with the Customer, total or partial non-payment of a previous order, refusal of credit card authorisation by the relevant banking institutions, or for any other valid reason. In such cases, the Service Provider shall under no circumstances be held liable.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">PAYMENT TERMS<\/h3>\n\n\n\n<p>5.1 Payment for purchases can be made by Visa or Mastercard credit cards and by \u201cMaestro\u201d debit cards.<\/p>\n\n\n\n<p>5.2 The products relating to the services ordered remain the property of the Service Provider until full payment has been made of the purchase price and the charges specified at the time of ordering.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. CANCELLATION<\/h3>\n\n\n\n<p>6.1 All orders are firm and final. However, if the Customer cancels their booking at least forty-eight (48) hours before the agreed date for the provision of the service, they may be refunded without giving a reason by sending a request to the Service Provider\u2019s email address, as set out in Article 1. If the cancellation is made less than forty-eight (48) hours before the agreed date for the provision of the service, the Customer will not receive any refund.<\/p>\n\n\n\n<p>6.2 The Service Provider may cancel the order no later than twenty-four (24) hours before the scheduled delivery date, and shall notify the Customer of this by email. The Service Provider shall offer to reschedule the service for another date or may also refund the amount paid by the Customer, upon request sent to the Service Provider\u2019s email address specified in Article 1.<\/p>\n\n\n\n<p>6.3 Clauses 6.1 and 6.2 shall be applied taking into account the statutory withdrawal period.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7. RIGHT OF WITHDRAWAL AND RETURN POLICY<\/h3>\n\n\n\n<p>7.1 The Customer has a period of fourteen (14) calendar days, starting from the day after the contract is concluded (= the day after the order is placed), to cancel their purchase without penalty and without giving any reason, in accordance with the Belgian Economic Law Code.<\/p>\n\n\n\n<p>Within this period, the Customer must notify the Service Provider of their intention to exercise their right of withdrawal, as follows:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Send an email to the address specified in Article 1<\/li>\n\n\n\n<li>Provide your first name and surname<\/li>\n\n\n\n<li>Please provide a detailed description of the service(s) in question, quoting the invoice number and date<\/li>\n<\/ul>\n\n\n\n<p>or<\/p>\n\n\n\n<p>fill in the <a href=\"https:\/\/economie.fgov.be\/sites\/default\/files\/Files\/Forms\/Formulaire-de-retractation.pdf\">form available on the FPS Economy website<\/a><\/p>\n\n\n\n<p>7.2 If the Customer wishes to exchange the item rather than receive a refund, they must state this in the email, and the Service Provider will inform them of the service\u2019s availability, as well as any additional charge or partial refund, where applicable.<\/p>\n\n\n\n<p>7.3 Should the Customer exercise their right of withdrawal, the Service Provider shall issue a refund without undue delay and, in any event, no later than fourteen days from the date on which the Customer notified the Service Provider of their decision to withdraw.<\/p>\n\n\n\n<p>7.4 In the event of a refund for returned services, the Service Provider shall credit the credit card used to pay for those services with an amount equivalent to their purchase price, less the value of any vouchers or discounts applied at the time of the order. The refund to the Customer shall be processed in accordance with the terms agreed with the card-issuing bank.<\/p>\n\n\n\n<p>7.5 If the Customer wishes for the service to commence during the withdrawal period, they must make an express request to this effect by sending an email to the Service Provider\u2019s address, as set out in Article 1. By submitting this express request, the Customer undertakes to pay an amount proportional to the service provided up to the time of the withdrawal request, in relation to the total services provided for in the contract.<\/p>\n\n\n\n<p>7.6 If the Customer wishes for the service to commence during the withdrawal period, they must make an express request to this effect by sending an email to the Service Provider\u2019s address, as set out in Article 1. By submitting this express request, the Customer acknowledges that they will lose their right of withdrawal once the contract has been fully performed by the Service Provider.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">8. PROTECTION OF CUSTOMERS\u2019 PERSONAL DATA<\/h3>\n\n\n\n<p>8.1 The Service Provider collects personal data relating to Customers, which is provided to it via the website or by email. It undertakes not to disclose this data to third parties. This data is confidential. It will be used by its internal departments solely for the processing of orders, for the purpose of enhancing and personalising communication, in particular through newsletters and emails, as well as for the personalisation of the website in accordance with Customers\u2019 observed preferences, or for credit checks.<\/p>\n\n\n\n<p>8.2 The Service Provider shall therefore not sell, market or rent out information concerning Clients to third parties. In the event of the transfer or use of personal data by third parties, the Service Provider undertakes to inform the Client in advance and to allow the Client to exercise their right to object. The Service Provider may also provide statistics relating to its Clients, its sales, the structure of transactions and information on the website to third parties, but these statistics shall not contain any personal data. This clause shall not, however, prevent the transfer or assignment of activities to a third party.<\/p>\n\n\n\n<p>8.3. The Service Provider shall retain personal data only for as long as is necessary to fulfil the specific purposes for which the data is processed. In determining the appropriate period, account is taken of the volume, nature and sensitivity of the personal data, the purposes for which it is processed and the possibility of achieving those purposes by other means. Account is also taken of the need to comply with its legal and regulatory obligations. When the data is no longer required, it is destroyed.<\/p>\n\n\n\n<p>8.4. Provided that the legal requirements are met, the Customer is entitled to:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>to request information to find out whether the Service Provider holds any personal data and, if so, what that data is and for what purposes it is processed;<\/li>\n\n\n\n<li>to access their personal data and, where appropriate, to have it corrected;<\/li>\n\n\n\n<li>to have such data erased or the processing of such data restricted, which allows;<\/li>\n\n\n\n<li>to lodge a complaint with the Data Protection Authority.<\/li>\n<\/ul>\n\n\n\n<p>The Customer may exercise the rights set out above by submitting a dated and signed request, accompanied, for security reasons, by a copy of their identity card. The request may be sent to the Service Provider by post to Thomas Gimzer, Rue Jacques Bassem 68, 1160 Auderghem, Belgium, and by email to <a href=\"mailto:hello@dryad-miniworlds.be\">hello@dryad-miniworlds.be<\/a>. If the request is manifestly unfounded, access may be refused and reasonable costs may be charged.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">9. LIABILITY<\/h3>\n\n\n\n<p>The Service Provider assumes only obligations of means in respect of all stages of accessing the website, from ordering to delivery or subsequent services. The Service Provider shall not be held liable for any inconvenience or damage arising from the use of the internet, including, but not limited to, service interruptions, external intrusion or the presence of computer viruses, or any event that may be classified as force majeure. In any event, the Service Provider\u2019s liability under these Terms and Conditions shall not exceed an amount equal to the sums paid or payable at the time of the transaction giving rise to such liability.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">10. INTELLECTUAL PROPERTY<\/h3>\n\n\n\n<p>The content of the website, including the underlying technology, may be protected by copyright, trade mark law or other intellectual property rights. The Service Provider authorises the Client to place a simple link on their own website that directs users directly to the Service Provider\u2019s website. However, any hyperlink to the website that uses framing, in-line linking or deep linking is prohibited. INVALIDITY AND ENTIRE AGREEMENT<\/h3>\n\n\n\n<p>If one or more provisions of these Terms and Conditions are found to be invalid, the remaining provisions shall remain in full force and effect.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">13. Proof<\/h3>\n\n\n\n<p>The electronic records stored in the Service Provider\u2019s and its partners\u2019 computer systems shall be deemed to constitute proof of communications, orders and payments between the parties. The parties agree to accept electronic evidence (e.g. emails, backups, etc.) in the context of their dealings.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">14. Changes<\/h3>\n\n\n\n<p>The Service Provider reserves the right to amend the Terms and Conditions and will notify the Customer of the new version via the website.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">15. APPLICABLE LAW AND JURISDICTION<\/h3>\n\n\n\n<p>These Terms and Conditions are governed by Belgian law. In the event of a dispute, an amicable resolution will be sought before any legal action is taken. The Service Provider and the Customer may also refer the matter to the European Online Dispute Resolution platform.
